Right to Information Act 2005

Right to Information Act 2005 mandates timely response to citizen requests for government information.

It may be noted that information provided under the Right to Information Act is available to citizens of India only. Applications should be submitted along with documentary proof of Indian Citizenship (like copy of personal particulars pages of passport.) The Government of India (Department of Post) has launched the e-IPO (Electronic Indian Postal Order) service to facilitate purchase of Indian Postal order electronically for paying RTI fee/cost of information on-line through e-Post Office Portal ( https:/www.epostoffice.gov.in ) of the Department of Posts. The detailed instructions for using the e-IPO service for payment of RTI fee on-line are contained in DOP & T OM No. 1/44/2009-IR dated March 22, 2013. (Please click here to get the details. The facility of e-ipo has been extended to 176 Indian Missions/Posts abroad also vide Department of Personnel & Training OM NO 1/44/2009-IR dated October 7, 2013 (please click here to see the OM). Department of Posts has extended the eIPO service to Indian citizens residing in India also w.e.f. February 13, 2014 vide OM No. 1/44/2009-IR dated 13th February 2014 (Please click here to see the OM). The RTI applicants may, therefore, pay the RTI fee/cost of information, also on-line using the said e-IPO service, for seeking information from Ministries/Departments in India as well as from Indian Missions abroad.

It may also be pointed out that as per section 6(1) (a) of the RTI Act, 2005, a person who desires to obtain information under the Act is required to submit the application to the Information Officer of the “concerned public authority”. Applicants are, therefore, advised to send their requests under the RTI Act to the Embassy only when the subject matter can reasonably be presumed to pertain to the Embassy. Where the information required obviously does not pertain to the Embassy, the application may be addressed to the concerned PIO directly.

(i)

the particulars of its organization, functions and duties;

The Embassy of India, Warsaw, functions under the supervision of the Ambassador and is concurrently accredited to the Republic of Lithuania. As such it discharges the following functions:-

Bilateral and Multilateral Political Relations;
Commercial and Economic Relations;
Visa and Consular matters; and
Culture, Education and Information

The Embassy functions within the purview of business allocated to the Ministry of External Affairs under the Government of India’s Allocation of Business Rules and Transaction of Business Rules.

(ii)

the powers and duties of its officers and employees;

General Administrative powers are derived from Indian Foreign Service Rules, as amended by the Ministry of External Affairs from time to time. Financial powers of the Officers of the Embassy of India have been detailed in the Delegated Financial powers of the Government of India’s Representatives Abroad. Other powers are derived from the Passport Act of India. The Officers of the Embassy function under the guidance and supervision of the Ambassador.

(iii)

the procedure followed in the decision making process, including channels of supervision and accountability;

Decisions are taken under the supervision of the Ambassador ,as directed by the Ministry of External Affairs from time to time.

(iv)

the norms set by it for the discharge of its functions;

Norms are specified by the Ministry of External Affairs

(v)

the rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions;

Indian Foreign Service (Pay, Leave, Compensatory Allowances and other Conditions of Service) Rules and Annexures; Financial Powers of Government of India’s Representatives abroad Rules Passport Act; Manual on Office Procedure; Other Central Government Rules and Manuals published by Central Government.

a statement of the categories of documents that are held by it or under its control;

The Embassy maintains files pertaining to Bilateral and Multilateral Political, Economic and Commercial, Cultural, Education and Information Relations. In addition, it discharges consular and visa functions as laid down by Ministry of External Affairs in the Consular Manual and Visa Manual, respectively.

the particulars of any arrangement that exists for consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof;

The Embassy does not consult the public in respect of policy formulation etc. However, for interaction with the public on consular and visa matters, a Suggestion and Complaint Box has been installed in the Consular Visitors Room in the Embassy. Besides, members of the public send their suggestions through electronic mode as well.

The Embassy functions within the budgetary allocation made by the Ministry of External Affairs. Please see Annexure-III

The Embassy also disseminates relevant information to the Polish citizens regarding India, its people and culture in the form of CDs and DVDs, facebook posts, pamphlets, brochures etc. which are freely made available to the public.
